Agentic Business Intelligence Solutions Limited ("ABIS HK")
Last updated: 21 October 2026
Summary
Welcome to ABIS HK. These Terms of Service govern your use of our website and any services we may make available to you. We build agentic AI tools to help individuals and organisations work smarter. Please read these terms carefully. If you do not agree, do not use our services.
1. Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of the services provided by Agentic Business Intelligence Solutions Limited ("ABIS HK," "we," "us," or "our"), including our website at https://www.abishk.ai and any related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, do not use our services.
Additional terms may apply if you subscribe to specific services (e.g., the Student Services Addendum for our agentic learning platform). Where there is a conflict, the specific addendum takes precedence over these base Terms.
2. Eligibility
You must be at least 18 years old to enter into a binding contract with us. By using our services, you represent and warrant that you meet this requirement and have not been previously suspended or removed from our services.
For minors: Our Student Services are available to users under 18 only through a registered parent or guardian account. The parent or guardian is the contractual counterparty and accepts these Terms (and the Student Services Addendum) on behalf of the minor. See the Student Services Addendum for details.
3. Account Registration
To access certain features (such as our Student Services or contact forms requiring follow-up), you may need to create an account. You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account.
You may not share your credentials with any other individual. For Student accounts, the Parent may share credentials with the Student and the Student's authorised tutor or educational supervisor, but the Parent remains liable for all account activity.
Notify us immediately at [email protected] if you suspect unauthorised access.
4. Use of Services
You agree to use our services only for lawful purposes. You may not:
- Violate any applicable laws or regulations of Hong Kong or your jurisdiction;
- Infringe the intellectual property or other rights of any third party;
- Transmit harmful, offensive, defamatory, or illegal content;
- Interfere with or disrupt our services, servers, or networks;
- Attempt to gain unauthorised access to our systems;
- Reverse engineer, decompile, or disassemble our software (except as permitted by law);
- Use automated means (bots, scrapers) to access our services without permission, except through authorised agentic features provided under a subscription;
- Circumvent any usage limits, rate limits, or access controls we impose.
5. Intellectual Property
Our property: ABIS HK and its licensors retain all rights in our Service, software, trademarks, designs, and content. These Terms do not grant you any right to use our branding without prior written consent.
Your content: You retain ownership of any content you submit to us (e.g., contact form messages). By submitting content, you grant us a limited, non-exclusive licence to process it solely to provide the Service and respond to you. We claim no ownership over your original materials.
Feedback: If you provide feedback or suggestions, you grant us a perpetual, irrevocable, royalty-free licence to use and incorporate such feedback without restriction.
6. Third-Party Services
Our services may integrate with or link to third-party services (e.g., Cloudflare for hosting, Stripe for payments). We are not responsible for third-party services, and your use of them is subject to their terms and policies.
7. Termination and Suspension
You may stop using our services at any time.
We may suspend or terminate your access if you violate these Terms, engage in fraudulent or illegal activity, or for any other reason with reasonable notice. Upon termination, your right to use our services ceases immediately.
For Student Services, termination and data retention are governed by the Student Services Addendum and our Data Retention Policy.
Provisions that by their nature should survive termination (such as ownership, indemnification, disclaimers, and limitations of liability) will survive.
8. Disclaimer of Warranties
Our Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our Services will be uninterrupted, error-free, or secure.
No AI warranty: The outputs of any AI-powered features (including agent task outputs and LLM-generated summaries) are generated by probabilistic models and may contain errors, hallucinations, outdated information, or inappropriate content. You are solely responsible for reviewing, verifying, and independently confirming any outputs before use. You should not rely on AI outputs for critical decisions without independent verification.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ABIS HK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING FROM OR RELATED TO YOUR USE OF OUR SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.
This limitation does not apply to liability that cannot be excluded under Hong Kong law (e.g., death or personal injury caused by negligence, fraud, or fraudulent misrepresentation).
10. Indemnification
You agree to indemnify, defend, and hold harmless ABIS HK and its officers, directors, employees, and agents from any claims, damages, losses, costs or expenses (including reasonable legal fees) arising from your use of our Service, your violation of these Terms, or your violation of any rights of a third party.
For Student Services, the parent or guardian (as the contractual counterparty) indemnifies us for claims arising from the student's use and agent configuration. See the Student Services Addendum.
11. Dispute Resolution
These Terms are governed by the laws of the Hong Kong Special Administrative Region, without regard to conflict of law principles.
Any dispute arising from these Terms or your use of our services shall first be subject to non-binding online mediation via the Hong Kong Mediation Centre or a mutually agreed online mediation platform if the claim amount does not exceed HK$50,000. The costs of mediation shall be shared equally unless the parties agree otherwise. If mediation does not resolve the dispute within 30 days, either party may bring proceedings in the courts of Hong Kong.
12. Changes to Terms
We may modify these Terms at any time. We will provide notice of material changes by updating the "Last updated" date and, for significant changes, by providing additional notice. Your continued use of our services after changes take effect constitutes acceptance of the revised Terms.
13. Severability and Waiver
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision does not constitute a waiver.

16. Definitions
Agentic (or agentic AI) refers to artificial intelligence systems that go beyond reactive prompts or simple chatbots. An agentic system receives a high-level objective, plans multi-step actions, makes autonomous decisions, uses external tools or APIs where needed, and adapts to changing conditions to accomplish the objective without constant human instruction or hand-holding.
